Activist investor Ancora received a powerful endorsement in its efforts to secure a board change and to oust Norfolk Southern CEO Alan Shaw on Monday, when proxy advisor Glass Lewis recommended the railroad's shareholders vote for 6 of Ancora's board nominees. "We believe Ancora has presented a compelling case for supporting a substantial overhaul of the Company's current leadership," Glass Lewis said in its report. Furthermore, Glass Lewis said Barber, Ancora's pick for CEO, and Jamie Boychuk, the activist's pick for COO, "have compelling credentials and track records." Ancora also seeks to install former CSX executive Boychuk as Barber's chief operating officer. Their support, coupled with Glass Lewis' endorsement, gives the activist powerful ammunition as it seeks to convince shareholders.

Last month, Norfolk Southern hired Orr away from rival CPKC, paying tens of millions of dollars to buy him out of his contract. A witness told the arbitrator that, in one instance, Orr told the employee that she "was so f------ stupid it was embarrassing." Prior to the announced hiring of Orr, Ancora drew attention to claims about his behavior in emails to two Norfolk Southern board members that CNBC obtained. Norfolk Southern told CNBC in a statement that Ancora's analysis of the value of the route — the Meridian Speedway agreement — "is completely inaccurate and based on a flawed premise," in that it assumes Norfolk Southern is forgoing more revenue than it actually is. Regarding Orr, Norfolk Southern said he has a "track record of improving performance while operating safely and with integrity."

(AP) — Transportation Secretary Pete Buttigieg has reiterated his concerns about railroad safety and scolded the industry for not doing more to improve since last year's fiery Ohio derailment. In a new letter to the freight railroads' main trade group, Buttigieg acknowledged that railroads say they are committed to safety. But he said too often regulators encounter resistance when trying to get the industry to do more to improve safety. And he said the Federal Railroad Administration's statistics don't show safety improving significantly over the past decade. But Buttigieg said that with two workers killed last year in rail yard accidents he's still concerned about those incidents.

Norfolk Southern responded on Monday, rejecting that slate and announcing it would nominate former Amtrak CEO Richard Anderson and former U.S. For Ancora, which has a successful track record as an activist investor, the proxy fight at Norfolk Southern would be its largest ever. CNN —Canadian teenager Christopher Morales Williams ran a stunning 400-meter world indoor record at the SEC Indoor Championships in Fayetteville, Arkansas, on Saturday. In 2018, American Michael Norman ran an indoor time of 44.52 which couldn’t be ratified as a record by World Athletics. “The world record – I guess that’s something you wouldn’t really expect to happen, but it did,” Morales Williams told reporters after Saturday’s race. And then I guess that’s always the result of it.”Morales Williams won the Canadian national championships and a silver at the Pan American U20 championships last year. Changpeng Zhao, founder and CEO of Binance, attends the Viva Technology conference dedicated to innovation and startups at Porte de Versailles exhibition center in Paris on June 16, 2022. The criminal sentencing of Binance founder Changpeng Zhao on a money laundering rule charge has been postponed until April 30, according to a notice Monday in Seattle federal court. That docket entry did not explain what would be a two-month delay in sentencing Zhao, a Canadian national widely known as "CZ" who is free on a $175 million release bond in the United States. Federal sentencing guidelines suggest a maximum sentence of 18 months in prison for Zhao, but prosecutors reportedly have considered asking for a harsher sentence. Zhao pleaded guilty on Nov. 21 to a charge of failure to maintain an effective anti-money laundering program at Binance, the world's largest cryptocurrency exchange.

When you see that in a railroad company, there is one key metric to look at, which drives railroad profitability and shareholder return: It's the operating ratio. The operating ratio is the company's operating expenses as a percentage of revenue. NSC's operating ratio is almost 69% and the right management team with the right strategy should easily be able to get the operating ratio down close to 60%. There is no need to reinvent the wheel here; the roadmap has already been drawn at Canadian Pacific and CSX. Inside the activist world, and among investors who were shareholders of Canadian Pacific and CSX, this is as sure of an activist strategy as there is.

Before last year, paid sick leave was generally not offered to railroad workers. That's instead of joining all the other major freight railroads in negotiating jointly with rail unions on an agreement over pay and benefits. The rail industry reached the brink of a strike in the fall of 2022 before Congress and President Joe Biden intervened to force rail workers to accept a contract. Union Pacific, BNSF and Norfolk Southern now have paid sick time agreements in place with all their unions. Canadian National also trails behind the big U.S. railroads, but still offers sick time to about 46% of its U.S. workers.

CNN —A top Pakistan official on Thursday accused India of killing two Pakistani nationals on its soil, citing what he called “a pattern” of alleged Indian assassination plots overseas and raising tensions between the two nuclear-armed rivals. India has long accused Pakistan of harboring terrorists, particularly in the disputed and heavily militarized region of Kashmir, which both countries claim in its entirety. Qazi on Thursday compared the alleged killings in Pakistan to other purported recent Indian assassination plots in North America. India and many other countries have publicly warned Pakistan cautioning that it would be consumed by its own culture of terror and violence,” MEA spokesperson Randhir Jaiswal said. The Indian government has denied involvement in the American and Canadian cases and has set up a high-level committee to investigate the accusations in the US.

Binance is also expected to expected to plead guilty to the charges. Zhao, the founder and CEO of Binance, has amassed a fortune that Bloomberg pegs at more than $23 billion. This alleged misconduct paved the way for Binance to become king of the crypto exchanges, prosecutors allege. Three people were arrested in New York City on Tuesday on charges of illegally smuggling millions of dollars' worth of electronics to Russia in order to aid the country's invasion of Ukraine. Federal prosecutors in Brooklyn accused Nikolay Goltsev, Salimdzhon Nasriddinov and Kristina Puzyreva of evading sanctions in order to send Russia equipment used in their precision-guided missile systems. The defendants allegedly dispatched hundreds of shipments of restricted items, worth nearly $7.2 million, to Russia over the course of a year. The complaint alleges that the defendants used two corporate entities to source and purchase dual-use electronics from U.S. manufacturers and distributors, and then secretly export them to Russia. CNN —Intelligence gained by the “Five Eyes” network led to Canada’s public accusation that the Indian government may have played a role in the assassination of a Sikh separatist activist on Canadian soil, the US Ambassador to Canada said Sunday. Five Eyes is an intelligence sharing pact between the United States, the United Kingdom, Canada, Australia and New Zealand, though the ambassador would not confirm if that shared intelligence came from the US. The spat then escalated further last week when India suspended visa services for Canadian citizens over what it said were “security threats” against diplomats in Canada. On Sunday, Canadian Defense Minister Bill Blair sought to shift the focus from questions over its intelligence to the criminal investigation of Nijjar’s killing. His death both shocked and outraged the Sikh community in Canada, one of the largest outside India and home to more than 770,000 members of the religious minority.

BP scaled back its energy transition strategy earlier this year but still stands out among rivals as the only oil major with plans to cut oil and gas output by 2030 by 25%. Auchincloss told staff in a brief town hall meeting on Wednesday that the company's aims were unchanged. As part of his energy transition strategy he had committed to BP reaching net-zero emissions by 2050. BP's strategy came under renewed scrutiny after rival Shell (SHEL.L) slowed down its energy transition strategy in June. "(The BP board) have enough flexibility within the current strategy to focus more on cash flow," a second source close to the company said.
